### Couple in a Severe Uber Crash Can’t Sue Because of an Uber Eats Order
A New Jersey couple, John and Georgia McGinty, who suffered severe injuries in an Uber crash, have been denied the opportunity to sue the company. The ruling comes from an appellate court, which determined that the couple had agreed to Uber’s terms of service when they placed an Uber Eats order, thereby binding them to an arbitration clause.
Georgia McGinty sustained multiple fractures and internal injuries, while her husband John suffered a fractured sternum and severe fractures to his left arm and wrist. Despite their claims that their 12-year-old daughter had accepted the terms while ordering pizza through her mother’s Uber Eats account, the court maintained that Georgia was still bound by the terms since she had accepted earlier versions.
The McGintys are reviewing the court’s ruling and plan to petition the New Jersey Supreme Court, hoping their case could influence legislative change to protect consumers.
